Participation in the Dance Theatre of Harlem @ NY City Center 2015 Contest (the “Contest”) constitutes your agreement to be bound by these Official Rules.

Eligibility: Open only to legal residents of the United States, 18 years of age or older at the time of entry. Employees, officers, and directors of Sponsor, its subsidiaries and its advertising and promotion agencies, and their immediate family members and persons living in their same household, are not eligible to participate in the Contest. Void outside of the 50 United States and where prohibited by law.
Entry: To enter the Contest:
1. Take a creative photo with a sign saying, "I'm going, are you?"
2. Post the photo to your Instagram account.
3. Tag the photo @dancetheatreofharlem and @browngirlsdoballet and use the hashtag #dthcitycenter2015.
Only one (1) entry per person. Duplicate entries may be disqualified. Your photo cannot contain any identifiable individuals other than you and members of your immediate family, and all identifiable individuals appearing in your photo must have provided you with their written consent to use the photo to enter this Contest.
Contest Period: The Contest begins on March 28, 2015 at 6:00 p.m. Eastern Time and ends on April 4, 2015 at 11:59 p.m. Eastern Time.
Prize: One winner will be selected. Winner will receive a pair of signed pointe shoes, a professional photo and a backstage experience with Ingrid Silva on any date the Dance Theatre of Harlem is performing at New York City Center in New York, NY you choose (see http://www.dancetheatreofharlem.org/ny-season-2015). A ticket to the performance is not included in the prize and is not required to win or participate in the prize. Given the unique and special nature of the prize, prize has no established retail value. No alternative prize, cash or other substitution is permitted except in the sole discretion of the Sponsor in the event of prize unavailability. All federal, state and/or local taxes, if any, are the sole responsibility of the winner.
Selection of Winner: The winner will be selected from all eligible entries received on or about April 5, 2015. The winner will be the person who submitted the most creative photo as judged by photographer Rachel Neville. Winner will be notified via Instagram message from Sponsor on or about April 5, 2015. As a condition to receiving the prize, the winner will be required to sign and return an affidavit of eligibility and liability and publicity release (“Affidavit and Release”). The winner must agree to the use of his or her name, voice and likeness for promotional purposes without further compensation, unless prohibited by law. In Sponsor’s sole discretion, anyone other than you appearing in your photo may be required to sign and return consent forms or releases as a condition of your winning the prize.
License to Use Photograph: As a condition to accepting a prize, winner agrees to provide Sponsor with a copy of the photo and grants Sponsor an irrevocable, exclusive, worldwide, royalty-free, fully paid up, transferable, unrestricted, license to use, reproduce, modify, publish, broadcast, distribute, display, sublicense and exercise all copyrights and other rights with respect to the photo, and to use the photo in marketing and promotional materials, on Sponsors’ websites and in any other works in any media now known or later created, without further review, notice, approval or compensation.
General Conditions: No purchase necessary. A purchase will not improve your chances of winning. Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right to disqualify, in its sole discretion, any person acting in an unsportsmanlike or disruptive manner, or tampering with the entry process, the operation of the systems required to conduct the Contest or operate the Sponsor web site, or who is otherwise in violation of these Official Rules. In the event of a dispute as to any entry, the authorized account holder of the Instagram Account used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder.
Limitations of Liability: Dance Theatre of Harlem and Brown Girls Do Ballet are not responsible for and shall not be liable for: (i) misdirected or delayed mail, e-mail or text messages; (ii) telephone, telecommunications, hardware or third party software malfunctions, failures, or difficulties of any kind; (iii) any injuries, losses, or damages of any kind arising in connection with or as a result of participating in the Contest or possession or use of any prize; (iv) any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Contest; (v) any printing or typographical errors in any materials associated with the Contest; or (vi) any condition caused by events beyond Sponsor’s control that may cause the Contest to be disrupted, corrupted or terminated. No more than the stated number of prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
Disputes: Except where prohibited, entrant agrees that: (1) any disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court located in New York, New York; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, shall be shall be determined by Sponsor in its sole discretion and governed by the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
